The September 15th hearing was opened at 10.45 A.M. with the presence of two prosecutors and the team of defense lawyers led by Johnson Panjaitan. The defendants were not present.

The prosecutors told the judges that because of a scheduling problem all of the prosecution team could not attend the hearing (some of the prosecution team had to sit in on another court case being held the same day) and asked the court to suspend the hearing until Tuesday, Sept. 19th, 2006, when they could all be in attendance. The prosecution asked that the session continue with witness examination. The prosecutors said that the witnesses were going to be from the Indonesian National Troop (TNI).

Mr. Panjaitan, from the defense team, asked if there were more victim witnesses to be examined since according to Mr. Panjaitan the victim witnesses should be examined first. In response to that question, the prosecutors argued that there are three victim/witnesses left to give testimony (the three Indonesians who were also shot in the ambush--they drove the three other vehicles). The prosecutors said that were still trying to persuade them to testify, because the three had concerns for their safety, should they testify at the hearing.

The judges adjourned the hearing until Tuesday, September 19, 2006, with the session witness examination.
